Labor protections for domestic workers have been inconsistent throughout U.S. history. The Fair Labor Standards Act of 1938 originally excluded domestic workers entirely. Home care workers only gained federal minimum wage protections in 2015 under Obama, after decades of advocacy. Caregiver wages have historically been kept low partly because this work was traditionally unpaid family labor performed by women. The aging population has grown 35% since 2010, making this workforce increasingly essential.
